EJEWELSTORE.COM TERMS AND CONDITIONS

MEMBERSHIP IS FREE, UNLESS OTHERWISE STATED.

These are the terms and conditions of the agreement between
you and ejewelstore.com that you agree to be bound by, upon
becoming an ejewelstore.com member. Please read them
carefully and if you do not agree with them, 
do not register as a member.

For YOUR SECURITY ejewelstore.com does NOT KEEP 
YOUR CREDIT CARD details on this internet site. All credit
card transactions from this site are transfered to our 
Bank's APPROVED SECURE SITE 'SECUREPAY' and only 
approval details are transferred back to us.

By registering as a member,

YOU AGREE TO THESE TERMS & CONDITIONS:

Members must be at least 18 years old. Please do not
attempt to register if you are under 18 years old.

You will only use your real name, address & identifying 
information. Deliveries will only be made to your legitimate
residential address. ejewelstore.com will not deliver to  
a recipient other than our properly registered member
unless prior arrangements are agreed to in writing by us.

PURCHASES:

This site offers members 'Buy-it-now' 'Lay-by' (lay-away)
& 'Gift Voucher' facilities. You will be confirming a 
purchase once you click on the 'make payment' or 'lay-by' 
or 'checkout' button on this site, and you will be transferred
to a secure site for credit card payments & information
regarding other payment methods will be provided.

Some purchases & lay-by's may be cancelled, but only 
with ejewelstore.com approval. 
Only CLICK THESE BUTTONS ONCE for each purchase.

LAY-BY (LAY-AWAY):

You can lay-by with a 6 month limit & 20% deposit.
Regular payments would be appreciated. (all payments are 
transferable to another item - but non refundable). We are
somewhat flexible & will do our best to fit in with your 
requirements.

Minimum combined Lay-By Purchases of $100 or more. 
 20% deposit & 6 month term to make full payment.
Lay-by may be cancelled if a deposit is not paid within 
7 days. You can Lay-by any item(s) by selecting the 
'lay-by' option once logged in as a member.
A lay-by is considered a confirmed order.

BUY-IT-NOW:

You have the option of a number of different payment 
options, including: Credit cards & Personal Cheques
(for Australian Residents as detailed below), Bank Deposit,
Money orders, International Bank Cheques, phone credit card 
payment & other (following email consultation & our agreement).
Clicking the buy now or lay-by links or buttons is an agreement
to buy, so please do not click if you don't want to buy.

GIFT VOUCHERS:

You may purchase a gift voucher by any payment method of
your choosing. Your member discount will be deducted from 
the purchase price & an email or letter will be sent to
the recipient advising them of your Gift together with
login information & Your personal message.
This will occur once your acceptable cleared payment has
been received.
Gift vouchers will not expire until credit is used or
recipient is declared un-contactable by us.

PAYMENTS:

Prices are quoted in Australian dollars & a calculator 
may be available to provide an approximate International
exchange rate in other currencies. We cannot guarantee
that this rate is accurate due to rapid movements in
international exchange rates. This is only a guide.

AUSTRALIAN BUYERS:

Prices are GST EXCLUSIVE. A Goods & Services Tax of 10%
IS APPLICABLE TO ALL PURCHASES within Australia.
Australian Credit card payment may be made securely online 
from our website. other payment options include;
Bank Deposit, Paypal, Cheque, money order or phone credit
card payment.

INTERNATIONAL BUYERS:

Paypal payments and Western Union money Orders
are accepted to confirmed addresses only. International
credit cards are NOT ACCEPTED directly due to our Banks
security regulations. Some fees may apply for payments 
using Personal cheques, International Bank cheques & 
Paypal, Western Union, International Money orders, as we
are charged fees by our Bank for accepting these payments.

Payments may also be made directly to our 
Bank account, Credit card payments will only be accepted 
from Australian Residents and deliveries will only be 
made to Australian residents residential addresses.

INSURANCE:

Shipping insurance for any items over $100 is payable
at a rate of 1.5% (as at 1-08-2006). This rate may vary
without notice due to increases in cost to us.

RETURNS REPLACEMENTS CREDITS & REFUNDS:

Purchases can be exchanged OR a credit voucher is 
available, if the item is not as stated. We do not 
refund however, if item is *as stated in our listing 
and freight & insurance costs are non-refundable. 
Item should be returned to us (insured) in the same 
condition as received, following email approval from us. 
*as stated is as rated in any provided appraisal.
Appraisals & retail valuations from different ratings
agencies can vary based on the opinion of the appraiser.

A 10% restocking fee on refunds (not replacements or 
credits) may apply in certain circumstances. Any attached
identification tags must not be removed from item. 
Claims needs to be made within 14 days of purchase date.

RESELLERS & DISTRIBUTORS:

Resellers. party planners, agents & distributors may 
receive a commission or reward on sales from members
they introduce to us. This will be set individually with our
reseller & distributor members.

DISPATCH OF GOODS:
 
ejewelstore.com will dispatch any completed purchase, 
via the shipping method selected, usually within 48-72
hours after cleared acceptable payment. Cheques 
and money orders etc. require around 5 "Bank"
business days for clearance. Goods will usually be 
dispatched within 48-72 hours of clearance being 
confirmed by our Bank.

International Deliveries may take longer to dispatch,
due to time constraints involved with clearance of 
payments etc. Transportation delays in air mail, Couriers
or your Country's postal services or Customs Services 
may also contribute. This is beyond our control & we
do not accept any responsibility for any such delays.

We reserve the right NOT to accept any merchandise 
as having been fully paid for, if an error has occurred in
the listing price, or a website coding error has not 
correctly priced this merchandise. In the event of this
occurrence, your purchase price will be fully refunded if
you do not agree to the correct price for the merchandise.

YOUR MEMBERSHIP RESPONSIBILITIES:

Choosing to checkout buy-it-now OR layby any item(s) is a 
contract to buy. If you do make a mistake, please inform us
within 7 days or you will be liable for completion of the
purchase.

As a member of ejewelstore.com, you agree to be 
responsible for costs of purchases, including lay-by's 
(lay-aways) Gift Vouchers and any fees (such as postage,
shipping & insurances etc) noted in our checkout. Also 
Charges including GST (if applicable) or International 
Customs Charges or duties & taxes or any other fees & 
charges accrued on your account in accordance with your 
purchases and shipping choices.

Cost of Freight will be paid by you, for each shipment,
for the prescribed method of your choice (if available). 
We will only ship by the means specified in our 
checkout system or agreed to in writing.

All goods advertised for sale on this site are sold as 
described, to the best of our ability, in the item 
description and images of the item. So please read 
descriptions carefully before you purchase.

Please read our 'Code of Practice' for details of our 
Customer satisfaction policy, returns & refund policy.

ejewelstore.com may also withhold any dispatch of 
goods if unapproved or uncleared payment has been
made for these goods until payments are fully cleared.

SPAM:

Members will not use ejewelstore.com mail systems 
to send junk mail or spam, only legitimate email 
communication with us is permited.

ejewelstore.com is not responsible for any information
or materials posted or transmitted via this site either 
via newsgroups bulletin boards or other information 
medium. No offensive, defamatory or material or
images, other than those directly relating to the 
normal business operations of this site and specified
as acceptable by ejewelstore.com, will be acceptable.

This agreement outlines behaviour that is acceptable
and unacceptable on this site, but ejewelstore.com is
not responsible for ensuring that members follow this
agreement.

The terms are subject to change by ejewelstore.com 
at any time. Please note that ejewelstore.com 
reserves the right to terminate or suspend your 
membership if deemed necessary, due to your improper or 
irresponsible use of this site or for non-payment of 
orders gift vouchers or laybys, fraud or suspected 
fraudulent activity at ejewelstore.com's sole discretion.

is covered by International & Australian copyright 
and may not be used in whole or part without the 
express permission of the ejewelstore.com proprietor(s). 
Any unauthorised use or infringement of copyright 
will lead to legal action & prosecution.

LIMITATION OF LIABILITY: Under no circumstances
will ejewelstore.com be liable for any incidental, 
consequential, direct or indirect damages arising from 
the use of the ejewelstore.com website or other related
business activity. 
In addition, ejewelstore.com disclaims all liability,
regardless of the form of action, for the acts or 
omissions of other members resellers or other users.
